FSA eligible jocks. Need opinion from our USA members

A potential customer just asked..

"I wanted to see how I can find which jocks are FSA eligible?!?!"

As a Canadian, I had never heard of FSA but I looked it up and found this from a website:

What Does “FSA Eligible” Mean?
“FSA eligible" refers to a product or service that will (likely) be covered by your Flexible Spending Account (FSA). The IRS determines FSA eligibility by defining “qualified medical expenses" as covered expenses for medical and dental care. Check out IRS Publication 502 or our FSA eligibility list to understand what is covered"

In our 18 years of business, I've never heard of jockstraps considered a medical expense but as I said, I'm Canadian.

Has any of our USA members tried to claim a jockstrap purchase as an expense?

Great question. I have FSA but have never thought about using it for a jock. I am anxious to see what the outcome is

Personally, I don't feel qualified to give him an answer. If anything, our sports jocks could be considered a medical expense if perhaps it was doctor recommended.

I just took a look at the above mentioned IRS Publication 502 and can't see clothing covered. But if a doctor recommended a supporter for genital support or after some operation then perhaps it could be an expense. Here's a link to the IRS Publication 502:

I would be hard to use the FSA cause you can not even find a jock strap in a pharmacy anymore wold have to buy it somewhere then save the receipt to send for a rembursiment. Would be too much trouble to do!

I've noticed that Amazon listings for certain jockstraps say you can use an FSA/HSA card to pay for them, but not all. Also, jockstraps on Shock Doctor's website indicate they're eligible for HSA/FSA, but not their compression shorts or standalone cups. Since Shock Doctor makes a lot of braces and other medical supports, they likely went through a process of getting a bunch of their items cleared for FSA/HSA.

It's probably the case that, if you got audited or something, you might have to show that a doctor recommended getting one, but I'm not 100% sure about that, and it's incredibly unlikely you'd get audited like that anyway (assuming you only bought a small amount and not like, hundreds). Worst case, the penalty for misuse of HSA funds isn't that bad.

I’d suggest he get a dr recommendation / Rx, and then submit for a FSA reimbursement from his FSA with a receipt for buying the jocks. Personally, I could see them being used for sports or a suspensory type jock after a medical proceduere. That said, if I could get my annual jockstrap spend covered by FSA funds; I’d absolutely love that!!!! Tax deductible fetish wear!!!!!!!!!
